Hinsdale grandmother injured in 2004 car accident A Cook County jury reached a 10.121 Million Dollar verdict Friday evening in the case of Harvey vs. K-5 Construction. Attorneys Mark McNabola and Adria Mossing at Cogan & McNabola, P.C. tried the case to verdict before Judge James P. Flannery. Seventy year-old Mary Harvey was driving to her daughter's Hinsdale home in 2004 when she was struck in an intersection by the defendant, James Fleck, an agent of K-5 Construction Company. How the intersection collision occurred was hotly debated. The defence contended that the driver had a green arrow and that Mary Harvey disobeyed the red light. Mrs Harvey testified that as she was going through the intersection on a green light, the defendant entered the intersection and turned left into her car. As a result of the accident, Mrs. Harvey suffered significant injuries including quadraparisis. Mary Harvey is married to Dr. Gene Harvey, a retired family practice physician, and they have four grown children. Prior to this accident, she enjoyed an active lifestyle. "Mr. Fleck's negligent driving took away Mary Harvey's ability to live her life to the fullest. She will never walk again due to his carelessness," said attorney Mark McNabola. "We are thankful that the jury believed our position 100%. This verdict completely validates Mary Harvey's actions that fateful day and will help her and her family emotionally and financially deal with this tragedy." After seven days of testimony, the jury reached its decision in favor of Mary Harvey in less than two hours. The order of judgment was filed on Monday, October 30, 2006.
