Cook County Jury Reaches $3.36 Million Verdict
May 1, 2008 - Attorneys John Power and Timothy Ashe of Cogan & McNabola, P.C. received a $3.36 Million verdict last night on behalf of William Lynch. Mr. Lynch suffered injuries as a result of a Functional Capacity Evaluation (FCE) performed at Riverside Medical Center in Kankakee on July 31, 2001. The verdict, along with a prior settlement, brings the total compensation to the plaintiff to over $5 Million.
The plaintiff, William Lynch contends that Riverside Medical Center and Debbie Sall were negligent during an FCE (Functional Capacity Evaluation), a test to determine work capabilities following physical therapy. During the test, he was instructed by Ms. Sall to pull a 170 pound sled 50 feet. He aggravated his prior back condition and herniated a disc. The incident required another surgery at the University of Chicago and the placement of a spinal cord stimulator. He will require medical treatment throughout his life and his ability to return to work as a roofing foreman has been seriously compromised.
"Mr. Lynch's life was forever changed the day he walked into Riverside Medical Center," said attorney John Power. "Because of this medical mistake, Mr. Lynch can no longer do many of the things he loves to do. This settlement doesn't change any of that, it simply allows him to pay for his ongoing medical problems."
