A man who fell from stairs in a home under construction will receive a $1.1 million settlement from the businesses building the house, according to the plaintiff's attorney.

Michael Evans went inside his home in 2002 to take measurements during construction and walked up a temporary staircase that had been removed to install hardwood flooring and wasn't secured when it was put back into place, Evans alleged.

The staircase moved suddenly, and he fell about 13 feet. He suffered injuries to his hip, back, knees and ankles.

Mark E. McNabola of Cogan & McNabola P.C. represented Evans. On Monday, Kearney Builders Inc. agreed to pay $650,000. The company was represented by Ken Klimczak of Bruce, Farrel, Dorn & Associates.

Color Hardwood Floors, which will pay $300,000, was represented by Thomas J. Long of Norton, Mancini & Weiler P.C. Long said that the stairs were secured and the fall was due to improper installation. Bayside Construction, to pay $150,000, was represented by James Bartlett of Stellato & Schwartz Ltd. Michael Evans and Rhonda Evans v. Kearney Builders Inc., et al., No. 02 L 16342.
