May 2005 - A 4.7 million-dollar settlement was reached today between ComEd and a Chicago man severely injured by an electric shock.
45 year-old Krzystof Nejman was hired to paint a Lincoln Park building in August 2002. Both the management company and the firm that hired him assured Mr. Nejman that the power was turned off. Kass Management claimed that they called ComEd four times to request a shut-off.
While painting, Mr. Nejman was on a ladder that came in contact with the electrical wires propelling him to the ground. He suffered burns to approximately 40% of his body. He also broke both heels, ribs and fractured his spine. He was hospitalized for three months. Mr. Nejman has undergone approximately twelve (12) surgeries and developed numerous infections as a result of his injuries. Mr. Nejman was the owner of his own painting and decorating firm but has not been able to work since the accident.
"Krzystof Nejman was told that ComEd shut off these lines and went about his work," said attorney Mark McNabola. "this mix-up cost him his livelihood and changed his life forever. This settlement now allows him to take care of his pressing medical needs and get his life back on track."
Expert witnesses would have testified that the wires were too close to the house and violate a national safety code.
A court order reflecting a settlement with ComEd was entered today by attorney Mark McNabola before Judge Robert Gordon.
